Second votes
decide.

Every voter has two votes. The Erststimme elects a constituency member; the Zweitstimme decides how many seats each party gets. Parties below 5 % get none: the BSW missed by 9 529 votes.

Share of valid second votes · seats · gold line: the 5 % threshold. The SSW is exempt as the party of the Danish and Frisian minorities.

The 2023 law at work

23 winners,
no seat.

A party's seats in each Land are fixed by its second votes first. Its constituency winners are then seated in order of their first-vote share until those seats run out. In Hesse the CDU won more constituencies than its list share covered; Frankfurt, Darmstadt and Groß-Gerau went unrepresented by their winners.
